Assault in the First Degree is a Class B felony in the State of New York.

A conviction of Assault in the First Degree will result in a minimum of a 5 year prison sentence and a maximum prison sentence of 25 years.

Assault in the Second Degree (New York Penal Law 120.05) – 2ndDegree Assault is defined as intentionally inflicting serious physical injuries to another person which causes death, serious impairment of physical health or creates a substantial risk of death.

Assault in the Second Degree is a Class D felony in the State of New York and is punishable with a minimum of 2 years in prison and a maximum of 7 years in prison. In addition, a fine of up to $5,000 plus a “mandatory surcharge” must be paid to the victim.

Assault in the Third Degree (New York Penal Law 120.00) – 3rdDegree Assault is defined as intentionally causing harm through a criminal act with a weapon or to inflict injury upon another person. Assault in the First Degree is a Class A Misdemeanor in the State of New York.

A conviction of Assault in the Third Degree can result in a prison sentence of up to 1 year and a fine totaling $1,000 or less.

In addition to a lengthy prison sentence, you will be required to pay restitution to the victim and fines.
